LEGAL REQUIREMENTS AND TRAFFIC REGULATIONS FOR MOTORCYCLE TOURS (2026)

1. Mandatory Equipment and Technical Requirements

Pursuant to Article 150 of the Highway Traffic Regulation and its current amendments, the following equipment is mandatory for motorcycle operation in Türkiye:

• Protective Helmet: Mandatory for both the operator and the passenger. Helmets must comply with international safety standards (e.g., ECE or DOT).

• Protective Eyewear: If the helmet is not equipped with a visor, the operator must wear goggles to protect the eyes.

• Reflective Apparel (Night Condition): It is a legal requirement for both driver and passenger to wear reflective vests, jackets, or equivalent high-visibility gear during night rides (from sunset to sunrise) and in low-visibility conditions.

• Daytime Lighting: Motorcycles must have their low-beam headlights illuminated at all times (including daytime) by law to ensure road safety.

• Passenger Requirements: To carry a passenger, the motorcycle must be equipped with a separate seat, fixed handholds, and dedicated footpegs.

2. Legal Speed Limits (L3 Category Motorcycles)

In accordance with the Traffic Law, the following speed limits apply to two-wheeled (L3) motorcycles:

Legal Provision: A 10% tolerance is applied to speed limits. For instance, in a 90 km/h zone, penalties start from 100 km/h. Please adhere strictly to posted signage on private motorways.

3. Operational and Traffic Conduct

• Lane Discipline: Motorcycles hold the same legal rights as passenger cars and are entitled to occupy a full lane. However, "lane splitting" or "filtering" through traffic is considered high-risk; in the event of an accident, the operator may be found primarily at fault.

• Sidewalks and Pedestrian Crossings: Operating a motorcycle on sidewalks or using pedestrian crossings while mounted is strictly prohibited.

• Group Riding: Riding side-by-side to occupy two lanes is illegal. The "Staggered (Zigzag) Formation" is recommended to maintain safe following distances.

• Cargo Limitations: Loads must not exceed 50 cm in width or extend more than 1 meter beyond the rear of the motorcycle. Cargo must not compromise the vehicle's balance or obscure the license plate.

4. Administrative and Legal Liabilities

Participants must present and maintain the following:

• Driving License: A valid license (Category A1 for <125cc, A2 for <35kW, or A for all) is mandatory.

• Insurance: All tour vehicles must be covered by valid Compulsory Financial Liability Insurance (Traffic Insurance).

• Liability for Violations: The operator may be held jointly liable for a passenger’s failure to wear a helmet during inspections.

5. Monetary Penalties and Enforcement (2026 Schedule)

Under 2026 regulations, the early payment discount period has been extended to 30 days.

• Unlicensed Operation: 40,000 TL (applied separately to both the driver and the vehicle owner).

• Inappropriate License Class: 11,629 TL.

• DUI (Alcohol): 9,268 TL for the first offense, with an immediate 6-month license suspension.

6. Critical Warnings for Tour Participants

• Pedestrian Priority: Failure to yield to pedestrians at marked crossings carries a penalty of 11,629 TL.

• Recreational Stunts: Stunt riding (wheelies, drifting, etc.) or endangering public safety carries severe penalties up to 58,217 TL.

• Shoulder Usage: The use of emergency shoulders (breakdown lanes) is strictly prohibited except for malfunctions.

• Hand Position: The operator must keep both hands on the handlebars (except for signaling) and both feet on the pegs at all times.
